Three Kinds of Outcomes
A California lemon law case generally resolves in one of three ways: the manufacturer buys the vehicle back (a refund), the manufacturer replaces the vehicle with a comparable one, or the manufacturer pays a cash settlement while you keep the car.
Which of these makes sense for your case depends on what you want, what the manufacturer is willing to offer, and what the numbers say. Harry walks through the tradeoffs with you directly, so you understand each option before a decision has to be made.
Option 1: The Buyback (Refund)
A buyback means the manufacturer takes the vehicle back and refunds what you paid — typically the purchase price, taxes, registration, and a portion of your finance charges, less a statutorily-defined offset for the miles you actually drove before the defect showed up.
This is often the right outcome when the vehicle has been more trouble than it's worth and you want to walk away cleanly. You get your money back (with adjustments) and you're no longer on the hook for a car you can't rely on.
Option 2: The Replacement
A replacement means the manufacturer swaps your defective vehicle for a comparable new one. You keep your payment history, your loan terms roll over to the new car, and you get a fresh vehicle that (ideally) doesn't have the same problem.
Replacement works well when you like the model and just want a properly-functioning copy of it. It's less common than the buyback, but it's a legitimate option when the facts line up.
Option 3: The Cash Settlement
A cash settlement is when the manufacturer writes you a check and you keep the car. This is common when the defect is annoying but not dealbreaker-level, or when you've decided you'd rather have the money than hand the vehicle back.
The amount depends on the severity of the defect, how far through the warranty the issue emerged, and the manufacturer's appetite to settle.
